Introducci\u00f3n<\/strong><\/h3>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-a9250c8424dd9e1c52ed59b7b4e19806\">La Corte Suprema ha emitido un pronunciamiento relevante en materia laboral y de g\u00e9nero: valida el despido por acoso sexual sustentado exclusivamente en la declaraci\u00f3n de la v\u00edctima. Esta decisi\u00f3n marca un precedente importante para la protecci\u00f3n de derechos laborales y para el tratamiento judicial del hostigamiento sexual en el trabajo.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading has-medium-font-size\"><strong>2. Marco Normativo<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-9100ecef379dcc97a65356b7f4cb7bdd\"><strong>Ley N.\u00ba 27942:<\/strong> Define el hostigamiento sexual laboral como conducta no deseada de \u00edndole sexual, usualmente en relaciones de jerarqu\u00eda.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-df8235875d26d2aba5e5b8fc0fbb2f7b\"><strong>D.S. N.\u00ba 014-2019-MIMP:<\/strong> Establece que la declaraci\u00f3n de la v\u00edctima puede ser prueba suficiente si es veros\u00edmil, persistente y no hay razones objetivas para dudar.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-6d55ed40ab063935c4a03b29f11f46eb\"><strong>Art. 29 del D. Leg. 728:<\/strong> El despido debe sustentarse en falta grave debidamente acreditada.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading has-medium-font-size\"><strong>3. Contenido del Fallo y Cambio Jurisprudencial<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-372466919a7a8a4bff1017e811ac5139\">La Corte Suprema confirma que el despido por acoso sexual <strong>puede basarse \u00fanicamente en el testimonio de la v\u00edctima<\/strong>.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-424d4630d3cc45f9c830aab0f9771a5b\">Se deja de exigir, como regla, otras pruebas complementarias (testimoniales, documentales o periciales).<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-44a6fb396161dea44efae7ad623444a6\">Se reconoce la especial dificultad probatoria en estos casos debido a su naturaleza privada y asim\u00e9trica.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>4. An\u00e1lisis Cr\u00edtico<\/strong><\/h3>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-5ef77875ff83d2a696bb88f1d3dc2ea8\"><strong>Ventajas del criterio:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-7d244656de5c40636df90235bd363b85\">Fortalece la capacidad sancionadora frente a acoso sexual.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-69402c31a3ccee3a7b76958ae8a2ff53\">Reconoce la dificultad estructural de prueba.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-2b13254100cb0d5674110c355ae4da20\">Refuerza la se\u00f1al de \u201ctolerancia cero\u201d al acoso en el \u00e1mbito laboral.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-e5afaf59f25100456a61d38216889f4c\"><strong>Riesgos y desaf\u00edos:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-2425206f6b598297a91dc6206ee95cd0\">Puede generar tensiones con el derecho de defensa del trabajador.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-f553d005d704f04adad631c3128a0179\">Exige par\u00e1metros estrictos de verosimilitud en la valoraci\u00f3n del testimonio.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-2e7f9543113866639cdb2d54452049f3\">Necesita procedimientos de investigaci\u00f3n internos robustos para evitar arbitrariedad.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading has-medium-font-size\"><strong>5. Requisitos para la Valoraci\u00f3n del Testimonio \u00danico<\/strong><\/h3>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-27bf5bca184e17b31ebe8e81e93ccdfe\">Seg\u00fan el art\u00edculo 20.4 del reglamento de la Ley 27942, el testimonio de la v\u00edctima <strong>puede desvirtuar la presunci\u00f3n de inocencia<\/strong> si cumple con:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-19bc4bd9a90bd3ac062d23c957a859fa\">Verosimilitud del relato<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-aa18ff7c0559b459609d08fff3e83602\">Ausencia de incredibilidad subjetiva<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-00aa5c0d3d552c6667b9f3ae5aaa4a49\">Persistencia de la incriminaci\u00f3n<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading has-medium-font-size\"><strong>6. Implicancias para Empleadores y Regulaci\u00f3n Interna<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-0876ad39bd44fcd90b780ad88b578f0d\">Actualizaci\u00f3n de protocolos de atenci\u00f3n a denuncias de hostigamiento sexual.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-ced6d21ea8f396896b58bf9f83ef919e\">Asegurar documentaci\u00f3n adecuada del proceso de investigaci\u00f3n.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-8af18cf2f1c442c8e3cc163da80e027c\">Formaci\u00f3n en perspectiva de g\u00e9nero para equipos de RR.HH.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-f2e6a3e03bed6983dd02b17e1c4cbd1f\">Reforzar mecanismos de protecci\u00f3n tanto para denunciantes como para denunciados.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading has-medium-font-size\"><strong>7. Relaci\u00f3n con Jurisprudencia Previa<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-c0bbc6197d6567a54671c3eaa6cbb37b\"><strong>Casaci\u00f3n N.\u00ba 41977-2022 (Tacna):<\/strong> Se valid\u00f3 el despido por hostigamiento sexual basado solo en la declaraci\u00f3n de la v\u00edctima, siempre que se haya cumplido el procedimiento.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-bf0096c34431a65d295af605d581fb85\">El fallo reciente <strong>consolida<\/strong> este criterio al <strong>eliminar la exigencia de prueba complementaria<\/strong> como condici\u00f3n necesaria.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading has-medium-font-size\"><strong>8. Conclusi\u00f3n<\/strong><\/h3>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-6c7bcc0ece4d8259089dd02dc413a0f7\">La Corte Suprema del Per\u00fa consolida una evoluci\u00f3n jurisprudencial que privilegia la protecci\u00f3n de v\u00edctimas de acoso sexual laboral, reconociendo la legitimidad del <strong>testimonio \u00fanico como prueba suficiente<\/strong> en despidos por falta grave.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-b116d898c65f6126b978b1eab04d3040\">Sin embargo, el criterio debe aplicarse con estricto rigor jur\u00eddico:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-1ce187a3b80e4d9b29317ee083dbe67a\">Investigaci\u00f3n interna bien documentada<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-0628aeab066f255f8a614ed0dfbb0d30\">Derecho de defensa garantizado<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-7512e9a489fecd51d4b6f4012200f974\">Evaluaci\u00f3n razonada de la credibilidad del testimonio<\/li>\n<\/ul>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-99e6f6142700269897dc5ebf001fb4c8\">Este fallo reafirma que el acoso sexual es una infracci\u00f3n grave a los derechos fundamentales, y que el derecho laboral debe contribuir activamente a su erradicaci\u00f3n sin sacrificar las garant\u00edas del debido proceso.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>1.
