Por ello, la <strong>sustentaci\u00f3n del requerimiento<\/strong> se convierte en un elemento decisivo para asegurar la transparencia, eficiencia y legalidad de los procesos.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-374286cba7c3df1ac658c4cae263eea5\">La <strong>Contralor\u00eda General de la Rep\u00fablica (2022)<\/strong> ha se\u00f1alado que una de las deficiencias m\u00e1s comunes en contrataciones de bajo monto es la falta de una adecuada justificaci\u00f3n, lo que genera observaciones posteriores en auditor\u00edas y limita la trazabilidad de la decisi\u00f3n administrativa.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading has-medium-font-size\">Marco normativo<\/h2>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-341b45cbbf33436e6b3dc8e9b7a8b0b6\">El <strong>Decreto Legislativo N.\u00b0 1017<\/strong> \u2013 Ley de Contrataciones del Estado y su Reglamento (<strong>D.S. N.\u00b0 344-2018-EF<\/strong>) establecen que:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-4cbf646eecbed4e61f597325d335cfb0\">Toda contrataci\u00f3n debe responder a una necesidad p\u00fablica debidamente sustentada.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-9e9b3b71e1380ba8efc7ec92b02b7afe\">El \u00e1rea usuaria es la responsable de elaborar y justificar el requerimiento.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-1b072ba180cabe6c57be83c13fbc1436\">Incluso en procesos menores a 8 UIT debe existir documentaci\u00f3n que acredite la necesidad, el objeto de la contrataci\u00f3n y la relaci\u00f3n costo-beneficio.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-4c17edc8fc1acbc6d26bf052dbafa8a3\">El <strong>OECE<\/strong> tambi\u00e9n ha resaltado, mediante gu\u00edas y directivas, la importancia de la trazabilidad documental como herramienta de control y prevenci\u00f3n de riesgos.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading has-medium-font-size\">Importancia de la sustentaci\u00f3n del requerimiento<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-3097948d62b488c5c1ca28098bcb3f4e\"><strong>Garantiza transparencia<\/strong>: acredita que la contrataci\u00f3n responde a una necesidad real.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-af19c4fd931984987f502e31fab334f6\"><strong>Evita fraccionamiento indebido<\/strong>: demuestra que no recursos p\u00fablicos.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading has-medium-font-size\">Lineamientos para fortalecer la sustentaci\u00f3n<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-e64947d5d0130417d4d445a2a7c253fc\">incluir un <strong>an\u00e1lisis de la necesidad real<\/strong>, identificando el problema y el objetivo.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-ccb372c0a14d69b82ae6cc3b65cac16e\">Definir con precisi\u00f3n el <strong>objeto de la contrataci\u00f3n<\/strong> (especificaciones t\u00e9cnicas o TDR).<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-a6e9c07ba1e0933ea02f42216fa1546f\">Justificar el monto con <strong>estudios de mercado u ofertas previas<\/strong>.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color
